Terms & Conditions
Sam’s Electrical LLC
Effective Date: 3/05/2026
These Terms & Conditions apply to service requests, estimates, quotes, invoices, and work performed by Sam’s Electrical LLC (“Sam’s Electrical,” “we,” “us”). By requesting service or authorizing work, you agree to these Terms & Conditions.
1) Payment Terms, Fees, and Deposits
Residential Payment Terms: Payment for residential services is due within 24 hours of service completion or receipt of invoice, whichever occurs later.
Commercial / Industrial Payment Terms: Commercial accounts are billed under Net 30 payment terms unless alternative terms are approved in writing by Sam’s Electrical LLC.
Sam’s Electrical may require deposits for larger projects, special-order materials, or extended-scope work, as outlined in the estimate or service agreement.
Deposit Refunds and Project Cancellation: Deposits are applied toward the project cost. If a project is canceled, Sam's Electrical may deduct from the deposit any costs already incurred, including but not limited to permit fees, utility coordination, engineering fees, administrative costs, labor performed, special-order materials, non-returnable materials, restocking fees, and other project-related expenses. If incurred costs exceed the deposit amount, the client remains responsible for the difference.
Payment Authorization: By approving an estimate, scheduling service, or authorizing work, the client authorizes Sam’s Electrical LLC to charge the payment method on file for completed work, cancellation charges, no-show charges, late fees, or other applicable service charges in accordance with these Terms & Conditions.
Financing: Financing: Sam’s Electrical may offer customer financing through Wisetack for eligible projects*. Financing availability, approval, loan amount, repayment term, and APR are determined by Wisetack and its lending partners, and are not guaranteed by Sam’s Electrical*. Checking financing options may not impact your credit score, but all financing remains subject to credit approval and lender terms*.
*All financing is subject to credit approval. Your terms may vary. Payment options through Wisetack are provided by our lending partners. For example, a $1,200 purchase could cost $104.89 a month for 12 months, based on an 8.9% APR, or $400 a month for 3 months, based on a 0% APR. Offers range from 0-35.9% APR based on creditworthiness. State interest rate caps may apply. No other financing charges or participation fees. See additional terms at https://wisetack.com/faqs. https://www.wisetack.com/faqs.
Service Authorization: Service requests require technician dispatch and scheduling adjustments. Sam’s Electrical may require a valid payment method on file and may place a temporary authorization hold prior to dispatch to cover diagnostic services, dispatch costs, or applicable cancellation charges.
Emergency Service Cancellation: Emergency service requests require immediate scheduling adjustments, technician availability, and reservation of emergency response resources. Once emergency service is approved, a minimum $200 emergency dispatch cancellation fee applies if the customer cancels more than 15 minutes after authorization, regardless of whether a technician has arrived on site. Additional charges may apply for labor performed, permit fees, utility coordination, special-order materials, administrative costs, or other expenses already incurred by Sam's Electrical.
Scheduled Appointment Cancellation: Scheduled service appointments reserve technician time, scheduling capacity, and resources. Appointments canceled within 24 hours of the scheduled service time are subject to a minimum $100 cancellation fee. Additional charges may apply for permit fees, utility coordination, engineering services, special-order materials, non-returnable materials, labor performed, administrative costs, or other project expenses already incurred by Sam's Electrical.
No-Show / Access Delay: Clients are responsible for ensuring timely and reasonable access to the property and designated work areas. When Sam’s Electrical arrives on site and access is not provided within 15 minutes, the appointment is considered a no-show, a $100 service charge is applied, and the appointment must be rescheduled.
Late Payment Fees: Accounts not paid within the required payment period are subject to monthly late payment fees applied as follows:
Outstanding balances up to $1,000: $100 per month
Outstanding balances $1,000 – $5,000: $200 per month
Outstanding balances over $5,000: $300 per month
Late fees continue to accrue monthly until the outstanding balance is paid in full, where permitted by law.
Returned Payments: A $75 fee applies to any returned, declined, or bounced checks or payments.
2) Permits and Code Compliance
Sam’s Electrical performs work intended to comply with applicable codes and regulations. Permits will not be pulled unless specifically stated in the estimate. If permitting is required or requested after the estimate is accepted, the scope and pricing may change.
3) Emergency / After-Hours Service
For electrical emergencies, Sam’s Electrical will make reasonable efforts to respond within 2 hours, subject to availability and conditions.
Emergency service outside normal business hours may include additional charges, typically $300 per hour plus a $150 emergency dispatch/service call fee, unless otherwise stated in writing.
4) Subcontractors
Sam’s Electrical may engage qualified subcontractors to assist with completion of the work.
5) Client Responsibilities
The client agrees to:
• Designate a primary point of contact authorized to make decisions, approve changes, authorize additional work, and receive communications on behalf of all property owners and interested parties.
• Provide safe, clear, and reasonable access to all work areas, electrical panels, meter locations, crawlspaces, attics, basements, utility rooms, garages, roofs, and other areas necessary to perform the work.
• Ensure work areas are free from excessive storage, debris, personal property, furniture, decorations, fragile items, hazardous conditions, and other obstructions that may interfere with the work.
• Secure pets, children, tenants, occupants, customers, employees, and other individuals away from active work areas.
• Provide access codes, keys, gate access, alarm codes, utility rooms, locked areas, and any other information necessary to access the property and perform the work.
• Ensure all customer-supplied fixtures, fans, devices, EV chargers, appliances, equipment, and materials specified in the estimate are present, complete, undamaged, and available on-site prior to the scheduled appointment. If required materials are unavailable, incomplete, damaged, incorrect, or inaccessible at the time of service, additional charges, return trip charges, rescheduling fees, or delays may apply.
• Disclose any known hazards, defects, concealed conditions, water damage, asbestos, mold, structural concerns, previous repairs, damaged wiring, unsafe conditions, or other information that may affect the work.
• Obtain any approvals required from landlords, property managers, tenants, homeowners associations, building owners, or other third parties.
• Provide timely selections, approvals, fixture specifications, and information necessary to avoid project delays.
• Protect, remove, or secure furniture, decorations, artwork, mirrors, collectibles, electronics, appliances, fragile items, valuables, vehicles, landscaping, and other personal property located within or near the work area before the scheduled appointment.
• Maintain all required working clearances around electrical equipment as required by applicable safety and electrical codes.
If Sam's Electrical must move, reposition, relocate, cover, protect, handle, or work around customer-owned property to gain access to the work area, such assistance is provided solely as a courtesy. The client acknowledges that Sam's Electrical is not a moving company and assumes all risk associated with the movement, handling, relocation, or temporary storage of customer-owned property. Sam's Electrical shall not be responsible for damage to furniture, decorations, artwork, mirrors, televisions, electronics, appliances, fixtures, antiques, collectibles, storage items, personal property, landscaping, or other belongings that are moved, handled, worked around, or located within the work area unless such damage is caused by gross negligence or intentional misconduct.
Failure to satisfy these responsibilities may result in delays, rescheduling, return trip charges, additional labor charges, cancellation fees, suspension of work, or termination of the project at Sam's Electrical's discretion.
6) Change Orders / Scope Changes
Any changes to the scope of work must be approved in writing by both parties. Additional charges may apply for changes requested after the initial assessment or after work has begun.
7) Project Timeline
Estimated timeframes are provided in good faith. Unforeseen site conditions, inspections, material availability, utility scheduling, or safety issues may affect completion. We will communicate known delays as soon as reasonably possible.
8) Lien Rights and Remedies
If the client fails to make payment in accordance with these Terms, Sam’s Electrical reserves the right to file a mechanic’s lien and/or pursue other legal remedies to secure payment for services rendered, where permitted by law.
9) Drywall / Surface Damage and Repairs
Any holes, cuts, or damage to drywall, ceilings, walls, plaster, tile, or other surfaces required to perform the work are the client’s responsibility to repair unless otherwise stated in the estimate. Sam’s Electrical will make reasonable efforts to minimize damage but may cut or access surfaces as necessary. Sam’s Electrical does not perform patching, painting, or surface repairs unless otherwise stated.
Property Preparation, Landscaping, and Restoration: The client is responsible for removing or protecting personal property, furniture, decorations, fragile items, landscaping, and other belongings located within or near the work area.
Unless specifically stated in the estimate, Sam's Electrical is not responsible for any kind of cosmetic repairs, landscaping restoration, lawn repair, grass seeding, erosion repair, settlement, appearance matching, aesthetic concerns, or restoration of disturbed surfaces. Trenching work typically includes backfilling with existing material only. Final grading, reseeding, sod installation, landscaping restoration, decorative stone replacement, mulch replacement, and similar cosmetic work are excluded unless specifically included in the estimate.
10) Troubleshooting / Diagnostic Work
Electrical troubleshooting and diagnostic work is inherently unpredictable. Hidden defects, intermittent failures, damaged wiring, concealed junction boxes, prior modifications, equipment failures, code violations, utility issues, and other unforeseen conditions may significantly affect the time required to identify and correct an electrical problem.
Sam's Electrical generally utilizes flat-rate troubleshooting service pricing rather than hourly billing. Troubleshooting service pricing is based on technician expertise, diagnostic equipment, travel, overhead, availability, scheduling impact, liability, and the value of the service provided, and is not solely based on the amount of time spent on-site. Whether an issue is identified and corrected in five minutes or requires the full diagnostic period, the service charge remains the same.
Troubleshooting service pricing typically includes diagnostic labor and minor repairs utilizing standard materials. Materials, parts, or equipment exceeding approximately $75 in value are not included and will be billed separately unless specifically stated otherwise in writing. Examples include, but are not limited to, main breakers, specialty breakers, AFCI/GFCI breakers, service conductors, meter equipment, disconnects, transfer equipment, surge protection devices, electrical panels, and other major electrical components.
Historically, approximately 90-95% of troubleshooting service calls are resolved during the initial visit. However, some electrical issues require extended diagnostics, multiple visits, specialized testing, concealed wiring investigation, utility coordination, major repairs, or component replacement. If additional troubleshooting, labor, repairs, return visits, or expanded scope of work are required beyond the original service, additional charges may apply and will be quoted separately or billed at Sam's Electrical's current rates.
The client is responsible for providing complete and accurate information regarding the electrical issue, including previous repairs, recent modifications, newly installed equipment, utility interruptions, known hazards, unusual events, intermittent symptoms, and any other information that may assist in diagnosis. Failure to provide relevant information may result in extended diagnostic time, additional visits, increased costs, delays, or misdiagnosis for which Sam's Electrical shall not be responsible.
Pricing displayed on websites, advertisements, social media, phone calls, text messages, emails, or other marketing materials is for general informational purposes only and may change without notice. Final pricing is determined solely by the written estimate, quote, invoice, service authorization, or agreement provided directly by Sam's Electrical. In the event of any discrepancy, the written estimate, quote, invoice, or service authorization shall control.
Troubleshooting pricing may vary based on technician availability, emergency priority level, travel requirements, urgency, after-hours scheduling, complexity, accessibility, safety concerns, weather conditions, market conditions, workload, and other operational factors. For reference only, non-emergency diagnostic labor commonly ranges around $200 per hour when hourly pricing is utilized; however, actual pricing may be higher or lower depending on the circumstances.
11) Estimates, Quote Validity, and Unforeseen Conditions
We provide estimates as accurately as possible based on known conditions. However, unforeseen conditions, hidden defects, accessibility limitations, or site conditions (especially with phone-based estimates) may impact final pricing.
Estimates are valid for 30 days unless otherwise stated.
Pricing may change due to material cost fluctuations, supply chain constraints, seasonal demand, or workload, even after quote aproval.
Emergency estimates are valid for up to 30 minutes.
Priority estimates are valid for up to 2 hours.
12) Customer-Supplied Materials
If the client supplies fixtures, chandeliers, fans, EV chargers, devices, appliances, equipment, materials, or other products for installation, the client is solely responsible for ensuring such items are correct, complete, compatible, code-compliant, undamaged, and suitable for the intended application.
The client is responsible for ensuring all customer-supplied materials specified in the estimate are present on-site and available at the scheduled appointment time. If required materials are unavailable, incomplete, inaccessible, incorrect, damaged, defective, delayed, or otherwise unsuitable for installation, Sam's Electrical may suspend work, reschedule the appointment, or return at a later date. Additional labor charges, service call charges, return trip charges, rescheduling fees, cancellation fees, and material procurement charges may apply.
Sam's Electrical is not responsible for verifying manufacturer specifications, compatibility, sizing, color selection, finish selection, aesthetic preferences, product performance claims, manufacturer defects, missing parts, damaged parts, shipping damage, warranty claims, recalls, software issues, networking issues, or product failures associated with customer-supplied materials.
No warranty, guarantee, or representation is provided by Sam's Electrical for any customer-supplied materials, equipment, fixtures, devices, appliances, fans, EV chargers, or other products. Any warranty claims must be directed to the manufacturer, retailer, distributor, or supplier.
Customer-supplied fixtures, chandeliers, antique fixtures, salvaged fixtures, used fixtures, glass fixtures, crystal fixtures, decorative lighting components, and other customer-supplied equipment may contain hidden defects, weakened materials, previous repairs, missing hardware, metal fatigue, brittle wiring, corrosion, manufacturing defects, or other conditions not visible prior to installation. While Sam's Electrical will exercise reasonable care during handling and installation, the client acknowledges that fragile components may crack, break, separate, fail, or become damaged during normal handling, transportation, assembly, removal, or installation procedures.
Sam's Electrical is not responsible for the repair, replacement, value, restoration, reimbursement, depreciation, loss of use, or consequential damages associated with customer-supplied fixtures, chandeliers, antique fixtures, salvaged fixtures, used fixtures, decorative components, glass components, crystal components, or other customer-supplied equipment that becomes damaged during installation unless such damage is caused by gross negligence or intentional misconduct.
Additional labor required due to missing hardware, incomplete assembly, damaged components, manufacturer defects, compatibility issues, previous modifications, prior repairs, code deficiencies, or unforeseen conditions will be billed separately at Sam's Electrical's current rates.
13) Company Service Stickers
Unless the client requests otherwise before completion of the work, Sam's Electrical LLC may place a small company service sticker on electrical equipment that we install, repair, service, inspect, or modify, including but not limited to electrical panels, disconnects, meter sockets, transfer switches, EV chargers, and similar electrical equipment.
These stickers may display Sam's Electrical's name, logo, contact information, QR code, customer identification number, installation or service date, or other service-related information. They are intended to provide a convenient reference for future service, warranty support, maintenance, and to identify work previously performed by Sam's Electrical.
Clients who do not wish to have company service stickers installed must notify Sam's Electrical before completion of the work. If no such request is made, the client is deemed to have consented to the placement of these stickers.
14) Communications (Phone, Text Message, and Email)
By providing your contact information, you consent to receive phone calls, text messages, and emails from Sam's Electrical regarding service requests, scheduling, appointment reminders, estimates, invoices, project updates, customer service, warranty support, follow-up communications, maintenance reminders, electrical safety recommendations, financing information, promotions, and other communications related to our services.
Message and communication frequency may vary. Standard message and data rates may apply to text messages.
You may request that Sam's Electrical stop sending promotional or marketing communications at any time by contacting us directly. This request will not affect communications necessary to provide services, process payments, administer warranties, respond to inquiries, or otherwise manage your account or active projects.
We do not sell customer phone numbers, email addresses, or contact information to third parties.
15) Audio, Video, and Photo Recording Consent (Massachusetts All-Party Consent – M.G.L. c. 272, § 99)
By accepting an estimate, quote, or invoice and authorizing work, the client expressly consents to audio recording, video recording, and photography of work activities and job-related interactions by Sam’s Electrical and its representatives.
Recording may be performed using wearable devices (including smart glasses), handheld devices, or fixed cameras, and may include audio, video, and still images.
Purpose: Job documentation, company records, quality control, technician training, safety verification, liability protection, dispute resolution, and marketing (website/social media).
Scope: Recording is limited to work areas and job-related interactions. Sam’s Electrical will not intentionally record private areas unrelated to the scope of work. Recordings will not be sold to third parties.
Marketing Authorization: The client grants Sam’s Electrical a perpetual, irrevocable, royalty-free right to use recorded audio, video, and images of work performed (including incidental capture of individuals present) for marketing and promotional purposes without compensation or further approval.
Objection / Revocation: Any objection must be submitted in writing prior to the start of work. Failure to object constitutes consent. The client agrees to inform all occupants/individuals present during the work of this recording consent.
